The new RA Criminal Code, which entered into force on July 1, 2022, provides for a new form of complicity, i.e. the criminal organization.
In accordance with paragraph 3 of Article 50 of the Law: “A crime is considered committed by a criminal organization if it is committed by a stable group or group of three or more persons with an objective to commit one or more crimes. The crime is considered to have been committed by a criminal organization even if the crime included in the intention of the person who created or led it was directly committed by at least one member of the group or by a person who is not a member of the group.”
Instead, the Code omits “organized group” and “criminal association” as forms of complicity.
